Mahkeme, yerel mahkemenin daha \u00f6nce ald\u0131\u011f\u0131 karar\u0131 onayarak, Ba\u015fm\u00fcft\u00fcl\u00fc\u011f\u00fcn talebinin as\u0131ls\u0131z oldu\u011funa h\u00fckmetti.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ba\u015fm\u00fcft\u00fcl\u00fck, 10.710 metrekarelik m\u00fcze binas\u0131n\u0131n eski bir medrese oldu\u011funu iddia ederek iadesini talep ediyordu. Yap\u0131lan teknik incelemeler, eski medrese binas\u0131 ile mevcut m\u00fcze aras\u0131nda bir ba\u011f oldu\u011funu g\u00f6sterse de, mahkeme bu karar\u0131n dayana\u011f\u0131n\u0131 farkl\u0131 bir noktaya ba\u011flad\u0131. Mahkemeye g\u00f6re, bina 1950 y\u0131l\u0131ndan sonra \u00f6nemli \u00f6l\u00e7\u00fcde yeniden in\u015fa edildi. Bu durum, m\u00fclkiyetin iadesine dair mevcut yasal d\u00fczenlemelerin kapsam\u0131 d\u0131\u015f\u0131nda kalmas\u0131na neden oldu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Filibe-Plovdiv Temyiz Mahkemesi&#8217;nin bu karar\u0131, <strong>Bulgaristan<\/strong>&#8216;daki benzer m\u00fclkiyet davalar\u0131 i\u00e7in emsal te\u015fkil edebilecek nitelikte. Ba\u015fm\u00fcft\u00fcl\u00fc\u011f\u00fcn, karara kar\u015f\u0131 en \u00fcst mahkeme olan Yarg\u0131tay&#8217;a itiraz etme hakk\u0131 bulunuyor. Bu s\u00fcre\u00e7, <strong>Bulgaristan<\/strong>&#8216;da tarihi binalar\u0131n m\u00fclkiyeti konusundaki tart\u0131\u015fmalar\u0131 yeniden g\u00fcndeme getirdi.
