Kurulu\u015fundan itibaren M\u00fcsl\u00fcman bir toplum yap\u0131s\u0131 h\u00fcviyetini ta\u015f\u0131yan Osmanl\u0131lar \u015fer\u2019i hukuku benimseyerek, devletin b\u00fct\u00fcn kurumlar\u0131nda bu sistemin devam\u0131n\u0131 sa\u011flam\u0131\u015flard\u0131r. Bir T\u00fcrk-\u0130sl\u00e2m devleti olan Osmanl\u0131y\u0131 \u00e7a\u011fda\u015f\u0131 di\u011fer devletlerden ay\u0131ran en \u00f6nemli yanlar\u0131ndan birisi ho\u015fg\u00f6r\u00fc denilen anlay\u0131\u015ft\u0131r. Osmanl\u0131lar bu ho\u015fg\u00f6r\u00fc anlay\u0131\u015f\u0131 sebebiyle, idareleri alt\u0131na ald\u0131klar\u0131 yerli unsurlar\u0131n din ve vicdan h\u00fcrriyetine m\u00fcdahale etmedikleri gibi, onlar\u0131 her t\u00fcrl\u00fc bask\u0131dan da kurtarm\u0131\u015flard\u0131r.<\/p>\n<p>Bu \u00e7er\u00e7evede 600 y\u0131l\u0131 a\u015fk\u0131n varl\u0131\u011f\u0131 s\u00fcresince Osmanl\u0131 Devleti \u00e7e\u015fitli din\u00ee ve sosyal gruplar\u0131n yan yana ya\u015famalar\u0131 konusunda tarih\u00ee bir \u00f6rnek durumundad\u0131r. Osmanl\u0131 Devleti\u2019nde M\u00fcsl\u00fcmanlar, H\u0131ristiyanlar ve Yahudiler yan yana ibadet etme ve kendi k\u00fclt\u00fcrel kimliklerini zenginle\u015ftirme imk\u00e2n\u0131 bulabildikleri gibi her toplumun farkl\u0131 hukuk\u00ee gelenek ve inan\u0131\u015flar\u0131na sayg\u0131 duyularak, bunlara gelenek ve ya\u015fant\u0131lar\u0131n\u0131 uygulama imk\u00e2n\u0131 sa\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>Bu anlamda Osmanl\u0131 Devleti Orta\u00e7a\u011f ve modern zamanlarda \u00fc\u00e7 tek tanr\u0131l\u0131 dini resmen tan\u0131yan, etnik ve dinsel gruplar\u0131yla birlikte uyumlu bir \u015fekilde bir arada ya\u015famalar\u0131n\u0131 g\u00fcvence alt\u0131na alan tek siyas\u00ee organizasyondur. \u00c7e\u015fitli \u00fclkelerde dinlerinden dolay\u0131 bask\u0131 ve zul\u00fcm g\u00f6ren gayrim\u00fcslimlere her zaman kucak a\u00e7an Osmanl\u0131 Devleti\u2019nde M\u00fcsl\u00fcman olmayanlara da ibadet ve vicdan \u00f6zg\u00fcrl\u00fc\u011f\u00fc tan\u0131narak, onlara dinlerini de\u011fi\u015ftirme konusunda hi\u00e7bir bask\u0131 yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>Belirtilen bu alt\u0131 y\u00fcz y\u0131ll\u0131k tarih boyunca, geni\u015f topraklar\u0131 \u00fczerinde yirmi farkl\u0131 etnik gruptan d\u00f6rt ayr\u0131 din mensubunu y\u00f6netmi\u015f olan Osmanl\u0131 Devleti\u2019nde \u00f6zellikle, kl\u00e2sik d\u00f6nemde bu birliktelik huzur ve bar\u0131\u015f i\u00e7erisinde ge\u00e7mi\u015ftir. Osmanl\u0131 Devleti bu birlik ve beraberli\u011fi tarihi boyunca uygulad\u0131\u011f\u0131 ho\u015fg\u00f6r\u00fc, adalet, ba\u015fka din,\u00a0<a class=\"autobesttag\" title=\"See the tag: dil (10 posts)\" href=\"https:\/\/www.bghaber.org\/bghaber\/tag\/dil\/\" rel=\"nofollow\">dil<\/a>\u00a0ve milletlere kar\u015f\u0131 sayg\u0131 ile \u0130sl\u00e2m dinindeki z\u0131mm\u00ee (Mal, can, \u0131rz ve dini i\u00e7in \u0130sl\u00e2m devleti taraf\u0131ndan g\u00fcvence verilmi\u015f olan ehl-i kitap) hukuku \u00e7er\u00e7evesinde birle\u015ftirerek olu\u015fturdu\u011fu Millet sistemi sayesinde sa\u011flam\u0131\u015ft\u0131r.<\/p><div id=\"bghab-3782855129\" class=\"bghab-icerik-icine bghab-entity-placement\"><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6203283170189293\" crossorigin=\"anonymous\"><\/script><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-client=\"ca-pub-6203283170189293\" \ndata-ad-slot=\"7303146466\" \ndata-ad-layout=\"in-article\"\ndata-ad-format=\"fluid\" data-full-width-responsive=\"true\"><\/ins>\n<script> \n(adsbygoogle = window.adsbygoogle || []).push({}); \n<\/script>\n<\/div>\n<p>Osmanl\u0131 toplum d\u00fczeni farkl\u0131l\u0131klar \u00fczerine kurulu olan bir d\u00fczen olup, bu mozaik toplum modeli inan\u00e7 farl\u0131l\u0131klar\u0131na g\u00f6re bi\u00e7imlenmi\u015f ve yasalarla korunmu\u015ftur. Bu model sosyo-k\u00fclt\u00fcrel ve din\u00ee pl\u00e2nda \u00e7o\u011fulcu bir nitelik ta\u015f\u0131maktad\u0131r. Osmanl\u0131daki bu \u00e7o\u011fulculuk, farkl\u0131l\u0131klar\u0131 koruma ve s\u00fcrd\u00fcrme bi\u00e7iminde anla\u015f\u0131lm\u0131\u015f ve uygulanm\u0131\u015ft\u0131r. Buna g\u00f6re Osmanl\u0131 Devleti\u2019nde toplumun \u00e7e\u015fitli din\u00ee ve k\u00fclt\u00fcrel kesimleri bir araya\u00a0gelir, fakat kendileri olmaktan \u00e7\u0131kmazlar, her grup kendi dinini, dilini, fikirlerini ve ya\u015fama bi\u00e7imini muhafaza ederdi.<\/p>\n<p>\u0130sl\u00e2miyet\u2019in kurulu\u015f y\u0131llar\u0131nda, \u0130sl\u00e2m devletinin temel esaslar\u0131ndan biri olarak ortaya \u00e7\u0131kan ve <em><strong>\u201c\u00fcmmet\u201d<\/strong> <\/em>anlay\u0131\u015f\u0131na dayanan bu sistemi geli\u015ftiren ve en iyi \u015fekilde uygulayan Osmanl\u0131lar olmu\u015ftur. Osmanl\u0131lar daha \u00f6nceki T\u00fcrk-\u0130slam devletlerinden devrald\u0131klar\u0131 bu sistemi geli\u015ftirerek, h\u00e2kimiyet kurduklar\u0131 \u00fclkelerde bu sisteme ba\u011fl\u0131 bir idare kurmu\u015flard\u0131r. Bu \u00e7er\u00e7evede yar\u0131m y\u00fczy\u0131la yak\u0131n bir d\u00f6nem boyunca birbirinden farkl\u0131 bir\u00e7ok milleti yap\u0131s\u0131nda bulundurmay\u0131 ba\u015faran Osmanl\u0131larda M\u00fcsl\u00fcmanlar, Yahudiler ve H\u0131ristiyanlar kendi k\u00fclt\u00fcr yap\u0131lar\u0131n\u0131 koruyarak bar\u0131\u015f i\u00e7erisinde birlikte ya\u015fam\u0131\u015flard\u0131r.<\/p>\n<p>Osmanl\u0131 millet sisteminde farkl\u0131l\u0131klar\u0131n korunmas\u0131 esas oldu\u011fu i\u00e7in, farkl\u0131l\u0131klar\u0131 benzer yapmaya y\u00f6nelik k\u00fclt\u00fcrel ve ulusal b\u00fct\u00fcnle\u015fme politika hi\u00e7bir zaman uygulanmam\u0131\u015ft\u0131r. Bu konudaki temel politika; devlet otoritesini tan\u0131may\u0131 ve onun gereklerini yerine getirmeyi esas alan politikad\u0131r.<\/p>\n<p><strong>Osmanl\u0131 Devleti, modern ulus devletlerin ve s\u00f6m\u00fcrge y\u00f6netimlerinin yapt\u0131\u011f\u0131 gibi topluluklar\u0131n farkl\u0131l\u0131klar\u0131n\u0131 ortadan kald\u0131rma yoluna gitmemi\u015f onlar\u0131 bir arada ya\u015fatabilmeyi ama\u00e7lam\u0131\u015ft\u0131r.<\/strong><\/p>\n<p>Nitekim Osmanl\u0131 y\u00f6netimi gayrim\u00fcslimleri cizye vergisi d\u0131\u015f\u0131nda hi\u00e7bir \u015fekilde birey olarak muhatap almam\u0131\u015f, millet olarak muhatap alm\u0131\u015ft\u0131r. Osmanl\u0131 topraklar\u0131ndaki\u00a0T\u00fcrk, Arap, Bosnal\u0131 ve Arnavut gibi etnik olarak M\u00fcsl\u00fcman topluluklar\u0131n yan\u0131nda, M\u00fcsl\u00fcman olmayan farkl\u0131 etnik k\u00f6kenden din ve mezheplere mensup topluluklar da ya\u015f\u0131yordu. Bunlar, \u0130sl\u00e2m hukukunun gayrim\u00fcslimlerle ilgili h\u00fck\u00fcmleriyle birlikte baz\u0131 d\u00f6nemlerde \u00e7\u0131kar\u0131lan \u00f6rf\u00ee h\u00fck\u00fcmlerin de sa\u011flad\u0131\u011f\u0131 bir d\u00fczen i\u00e7erisinde ya\u015fam\u0131\u015flard\u0131r.<\/p><div id=\"bghab-2521648057\" class=\"bghab-icerik-icine-10-paragraf bghab-entity-placement\"><script async src=\"\/\/pagead2.googlesyndication.com\/pagead\/js\/adsbygoogle.js?client=ca-pub-6203283170189293\" crossorigin=\"anonymous\"><\/script><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-client=\"ca-pub-6203283170189293\" \ndata-ad-slot=\"7303146466\" \ndata-ad-layout=\"in-article\"\ndata-ad-format=\"fluid\" data-full-width-responsive=\"true\"><\/ins>\n<script> \n(adsbygoogle = window.adsbygoogle || []).push({}); \n<\/script>\n<\/div>\n<p><strong>\u0130sl\u00e2m hukukuna g\u00f6re, d\u00fcnyadaki insanlar M\u00fcsl\u00fcmanlar ve Gayrim\u00fcslimler olmak \u00fczere iki gruba ayr\u0131l\u0131r.<\/strong> \u0130sl\u00e2m hukukunda gayrim\u00fcslimler, bulunduklar\u0131 k\u0131sma g\u00f6re farkl\u0131 stat\u00fclere sahiptiler.\u00a0Vatanda\u015fl\u0131k\u00a0fertle devlet aras\u0131ndaki siyas\u00ee ve hukuk\u00ee ba\u011f olarak tan\u0131mland\u0131\u011f\u0131na g\u00f6re, \u0130sl\u00e2m \u00fclkesinde daimi olarak ya\u015fayan insanlar ister M\u00fcsl\u00fcman isterse gayrim\u00fcslim olsun bu \u00fclkenin vatanda\u015flar\u0131d\u0131r.<\/p>\n<p><strong>Buna g\u00f6re Osmanl\u0131\u2019da gayrim\u00fcslimler de t\u0131pk\u0131 M\u00fcsl\u00fcmanlar gibi, b\u00fct\u00fcn haklara sahiplerdir.<\/strong> Gayrim\u00fcslimlerin de evlenme, \u00e7ocuklar\u0131na veli olma, vasi tayin etme, nafaka, miras, mal ve m\u00fclk edinme haklar\u0131 vard\u0131r. Bu \u00e7er\u00e7evede Osmanl\u0131\u2019da gayrim\u00fcslimlere kamu d\u00fczenini ilgilendiren konularda \u0130sl\u00e2m hukuku kurallar\u0131 uygulanm\u0131\u015f, aile, miras ve bir k\u0131s\u0131m ticaret hukuku konular\u0131nda ise, kendi inan\u00e7lar\u0131ndan kaynaklanan \u00f6zel hukuk kurallar\u0131yla ba\u015f ba\u015fa b\u0131rak\u0131lm\u0131\u015flard\u0131r. Bu durum, insan haklar\u0131na, inan\u00e7 ve vicdan h\u00fcrriyetine sayg\u0131l\u0131 olma a\u00e7\u0131s\u0131ndan o devirler i\u00e7in olduk\u00e7a ileri bir uygulamad\u0131r.<\/p>\n<p><strong>\u0130\u015fte Osmanl\u0131lar\u0131n g\u00f6sterdi\u011fi ho\u015fg\u00f6r\u00fc ve geli\u015ftirdi\u011fi bu sistem<\/strong> sayesinde Osmanl\u0131 \u00fclkesinde ya\u015fayan \u00e7e\u015fitli dinlere, mezheplere ve \u0131rklara mensup insanlar as\u0131rlarca her t\u00fcrl\u00fc g\u00f6r\u00fc\u015fleriyle \u0130sl\u00e2m k\u00fclt\u00fcr ve medeniyeti \u00e7er\u00e7evesi i\u00e7erisinde varl\u0131klar\u0131n\u0131 korumu\u015flard\u0131r. Yine Osmanl\u0131lar\u0131n uygulad\u0131\u011f\u0131 bu \u00e7ok k\u00fclt\u00fcrl\u00fc ya\u015fam sayesinde as\u0131rlardan beri din ve mezhep kavgalar\u0131n\u0131n devam etti\u011fi Orta Do\u011fu\u2019da, Kafkaslarda ve Balkanlarda huzur ve asayi\u015f sa\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>Anadolu\u2019da ho\u015fg\u00f6r\u00fc denilince, hepimizin akl\u0131na gelen ilk \u00fc\u00e7 isim ku\u015fkusuz; Hac\u0131 Bekta\u015f-\u0131 Veli, Mevl\u00e2n\u00e2 Cel\u00e2ledd\u00een-i R\u00fbm\u00ee ve Yunus Emre\u2019dir. Yesev\u00eelik \u00f6\u011fretilerini takip eden ve Horasan erenlerinden olan Hac\u0131 Bekta\u015f, Bekta\u015filik tarikat\u0131n\u0131n kurucusudur. Devrin \u00f6nde gelen mutasavv\u0131flar\u0131ndand\u0131r ve mensubu oldu\u011fu Ah\u00eelik Te\u015fkilat\u0131 ile t\u0131pk\u0131 Mevl\u00e2n\u00e2 ve Yunus gibi Osmanl\u0131 Devleti\u2019nin kurulu\u015f a\u015famas\u0131nda toplumu derinden etkilemi\u015f, Anadolu\u2019nun sosyolojik geli\u015fimine b\u00fcy\u00fck katk\u0131 sunmu\u015ftur. Ge\u00e7mi\u015fte dervi\u015f ve erenlerin en \u00f6nemli duraklar\u0131ndan biri olan Bekta\u015fi Derg\u00e2h\u0131 Anadolu topraklar\u0131na ho\u015fg\u00f6r\u00fc tohumlar\u0131n\u0131 ekmi\u015ftir.<\/p>\n<p>Mevlana \u00f6\u011fretisi, sadece Anadolu ve \u0130slam co\u011frafyalar\u0131n\u0131 de\u011fil, yery\u00fcz\u00fcndeki t\u00fcm semavi din ve bir\u00e7ok medeniyeti derinden sarsm\u0131\u015ft\u0131r. Mevlevi Felsefesi o kadar etkili ve kapsay\u0131c\u0131 ki g\u00fcn\u00fcm\u00fczde dahi sosyal bilimler alan\u0131nda uluslararas\u0131 bir\u00e7ok akademide Mesnev\u00ee\u2019si ders olarak okutulmaktad\u0131r. Divan-\u0131 Kebiri\u2019nde insanlara olan evrensel yakla\u015f\u0131m\u0131n\u0131 \u015fu \u015fekilde dile getiriyor: \u201c<strong><em>D\u00fcnyada \u00e7e\u015fitli diller, l\u00fcgatler var, fakat hepsinin de anlam\u0131 birdir, \u00e7e\u015fitli kaplara konan sular kaplar k\u0131r\u0131l\u0131nca birle\u015firler, bir su halinde akarlar.<\/em><\/strong>\u201d Evet, su burada insand\u0131r ve hepimiz kal\u0131plar\u0131m\u0131z\u0131n i\u00e7inde bamba\u015fka \u015fekillerde olsak da kabuklar\u0131m\u0131zdan \u00e7\u0131k\u0131p kimliklerimizi terk etti\u011fimiz anda hepimiz bir ve beraberiz. Yine Mevl\u00e2n\u00e2 o hepimizin bildi\u011fi \u00f6\u011f\u00fcd\u00fcnde \u015f\u00f6yle demektedir: \u201c<strong><em>\u015eefkat ve merhamette g\u00fcne\u015f gibi ol, Ba\u015fkalar\u0131n\u0131n kusurunu \u00f6rtmede gece gibi ol, Hiddet ve asabiyette \u00f6l\u00fc gibi ol, Tevazu ve al\u00e7akg\u00f6n\u00fcll\u00fcl\u00fckte toprak gibi ol, Ho\u015fg\u00f6r\u00fcrl\u00fckte deniz gibi ol, Ya oldu\u011fun gibi g\u00f6r\u00fcn, ya da g\u00f6r\u00fcnd\u00fc\u011f\u00fcn gibi ol!\u201d<\/em><\/strong><\/p>\n<p>Mevl\u00e2n\u00e2\u2019n\u0131n insan sevgisi ve ho\u015fg\u00f6r\u00fcy\u00fc temel alan bu felsefesi, \u2018<strong><em>\u2019sen bakmas\u0131n\u0131 bil de dikende g\u00fcl g\u00f6r, dikensiz g\u00fcl\u00fc herkes g\u00f6r\u00fcr\u2019\u2019<\/em><\/strong>\u00a0s\u00f6z\u00fcyle i\u00e7inde bulundu\u011fumuz d\u00fcnyaya okkal\u0131 bir tokat atmaktad\u0131r.<\/p>\n<p><strong><em>Gelin tan\u0131\u015f olal\u0131m,<br \/>\n<\/em><\/strong><strong><em>\u0130\u015fi kolay k\u0131lal\u0131m,<br \/>\n<\/em><\/strong><strong><em>Sevelim sevilelim,<br \/>\n<\/em><\/strong><strong><em>D\u00fcnya kimseye kalmaz.<\/em><\/strong><\/p>\n<p>Anadolu\u2019nun yap\u0131s\u0131nda bulunan ho\u015fg\u00f6r\u00fc refleksi tasavvufi anlay\u0131\u015fla birle\u015fmi\u015f ve ard\u0131ndan Yunus\u2019ta adeta doru\u011fa ula\u015fm\u0131\u015ft\u0131r. Bu durum \u015fiirlerinde de t\u00fcm aleniyetiyle kar\u015f\u0131m\u0131zda durmaktad\u0131r.
