Ayet ve hadislerde t\u00f6vbenin ve anlam yak\u0131nl\u0131\u011f\u0131 i\u00e7inde bulundu\u011fu kavramlar\u0131n\u0131n kullan\u0131l\u0131\u015f\u0131 g\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda t\u00f6vbenin bezm-i elestte Allah ile kul aras\u0131nda yap\u0131lan ahdin tazelenmesini veya her insan\u0131n f\u0131trat \u00e7izgisine d\u00f6nmesini ve onu korumas\u0131n\u0131 ifade etti\u011fi anla\u015f\u0131l\u0131r. \u00c7\u00fcnk\u00fc kul selim f\u0131trat\u0131nda mevcut ahit \u015fuurundan zaman zaman uzakla\u015fmakta veya bunu tamamen unutmaktad\u0131r. Ki\u015finin i\u015fledi\u011fi k\u00f6t\u00fcl\u00fckler Allah Te\u00e2l\u00e2 ile iman aras\u0131ndaki ba\u011f\u0131 zedelemekte, her zaman vaadini ve ahdini yerine getiren y\u00fcce yarat\u0131c\u0131dan onu uzakla\u015ft\u0131rmaktad\u0131r. T\u00f6vbe de bu uzakla\u015fmaya son verme \u00e7abas\u0131d\u0131r. Dolay\u0131s\u0131yla t\u00f6vbe ruhun Allah\u2019a a\u00e7\u0131l\u0131\u015f\u0131n\u0131 ve y\u00fcceli\u015fini hedefleyen duaya benzemektedir. Esasen Kur\u2019an\u2019da ve hadislerde yer alan t\u00f6vbe ve isti\u011ffar ifadelerinin \u00e7o\u011fu dua ve niyaz \u00fcsl\u00fbbundad\u0131r. \u0130l\u00e2h\u00ee rahmetin geni\u015fli\u011fini ifade eden bir\u00e7ok rivayet, t\u00f6vbenin Allah ile m\u00fcmin aras\u0131ndaki dostlu\u011fun devam\u0131n\u0131 sa\u011flayan bir vas\u0131ta oldu\u011funu g\u00f6sterir. B\u00fct\u00fcn il\u00e2h\u00ee dinlere g\u00f6re insan hem iyilik hem k\u00f6t\u00fcl\u00fck yapma temay\u00fcl\u00fcne sahip bir varl\u0131kt\u0131r. Hz. \u00c2dem hata etmi\u015f, fakat t\u00f6vbe ile rah\u00eem olan Allah\u2019\u0131n aff\u0131na mazhar olmu\u015ftur. Asl\u0131nda t\u00f6vbe iman\u0131n bir tezah\u00fcr\u00fcd\u00fcr; bezm-i elestte Allah\u2019a verilen s\u00f6z\u00fcn hat\u0131rlanmas\u0131 ve yap\u0131lan ahdin tazelenmesidir; Kur\u2019an\u2019da i\u015faret edildi\u011fi gibi (e\u015f-\u015eems 91\/9-10) nefsini kirlerden ar\u0131nd\u0131rma \u00e7abas\u0131d\u0131r.<br \/>\nKur\u2019\u00e2n-\u0131 Ker\u00eem\u2019de t\u00f6vbe etme hakk\u0131n\u0131n t\u00f6vbeyle, il\u00e2h\u00ee affa mazhar olabilme imk\u00e2n\u0131n\u0131n bilerek ve inatla de\u011fil de cehalet y\u00fcz\u00fcnden k\u00f6t\u00fcl\u00fck yapan kimseye verildi\u011fine i\u015faret edilir (en-Nis\u00e2 4\/17; el-En\u2018\u00e2m 6\/54; en-Nahl 16\/119). Buradaki cehalet \u201cbilgisizlik\u201d anlam\u0131na geldi\u011fi gibi \u201cbe\u015fer\u00ee hislerin bask\u0131s\u0131 alt\u0131nda bulunan kalbin duyars\u0131zl\u0131\u011f\u0131\u201d m\u00e2nas\u0131na da al\u0131nabilir. Allah\u2019\u0131 rab, Muhammed\u2019i peygamber ve \u0130sl\u00e2m\u2019\u0131 din olarak kabul eden kimsenin bu gafleti uzun s\u00fcrmez, pi\u015fmanl\u0131k duyarak t\u00f6vbe eder; Nis\u00e2 s\u00fbresindeki \u00e2yetin devam\u0131 da buna i\u015faret etmektedir. \u015eu halde t\u00f6vbenin ilk \u015fart\u0131 ned\u00e2mettir, \u00c2limler t\u00f6vbenin Allah nezdinde kabul edilmesinin bu \u00fc\u00e7 \u015fart\u0131na (ned\u00e2met, terk, tekrar i\u015flememe) bir d\u00f6rd\u00fcnc\u00fcs\u00fcn\u00fc eklemi\u015ftir; o da iyi amel i\u015flemek suretiyle ge\u00e7mi\u015fteki hatalar\u0131n tel\u00e2fi edilmesidir. Bu d\u00f6rt \u015fart\u0131n \u00fc\u00e7\u00fcnc\u00fcs\u00fcn\u00fc olu\u015fturan g\u00fcnah\u0131 tekrar i\u015flememe hususu Allah\u2019\u0131n ma\u011ffiretine kavu\u015fmak i\u00e7in Kur\u2019an\u2019da \u015fart ko\u015fulmu\u015ftur (\u00c2l-i \u0130mr\u00e2n 3\/135). Nefs\u00e2n\u00ee arzular\u0131na kap\u0131labilen insan i\u00e7in zor bir s\u0131nav olan bu noktada t\u00f6vbe te\u015febb\u00fcs\u00fcnde \u00f6ncelik verilmesi gereken \u015fey bir daha yapmamaya kesin karar vermektir. Bununla birlikte g\u00fcnah\u0131n tekrar i\u015flenmesi durumunda yine pi\u015fmanl\u0131k duyup bir daha yapmamaya azmetmek gerekir.<br \/>\n\u00c2limler, i\u015flenen g\u00fcnahlar\u0131n t\u00f6vbeden sonra amel defterinden silinmesi i\u00e7in t\u00f6vbek\u00e2r\u0131n baz\u0131 tel\u00e2filere giri\u015fmesinin gerekti\u011fini belirtir:<br \/>\n1-G\u00fcnahlar kul hakk\u0131yla ilgili olmay\u0131p sadece il\u00e2h\u00ee haktan ibaretse ve bunlar\u0131n i\u00e7inde kaz\u00e2s\u0131 m\u00fcmk\u00fcn farz ibadetler varsa bunlar kaz\u00e2 edilmelidir.<br \/>\n2-Kul hakk\u0131na y\u00f6nelik g\u00fcnahlara gelince; bu konuda as\u0131l olan Hz. Peygamber\u2019in \u015fu t\u00e2limat\u0131d\u0131r: \u201cM\u00fcsl\u00fcman karde\u015finin mal\u0131na veya \u015feref ve namusuna y\u00f6nelik g\u00fcnah i\u015fleyen kimse alt\u0131n ve g\u00fcm\u00fc\u015f\u00fcn bulunmad\u0131\u011f\u0131 g\u00fcn gelmeden \u00f6nce ondan hel\u00e2llik dilesin. O g\u00fcn, d\u00fcnyada k\u00f6t\u00fcl\u00fck yapan kimsenin sevaplar\u0131 varsa haks\u0131zl\u0131\u011f\u0131 kadar al\u0131n\u0131p ma\u011fdura verilir, yoksa onun g\u00fcnah\u0131ndan al\u0131n\u0131p berikine y\u00fcklenir\u201d (M\u00fcsned, II, 435, 506; Buh\u00e2r\u00ee, \u201cRi\u1e33\u0101\u1e33\u201d, 48, \u201cMe\u1e93\u00e2lim\u201d, 10). Yap\u0131lan k\u00f6t\u00fcl\u00fckler hel\u00e2llik s\u0131ras\u0131nda hak sahibine haber verilir, r\u0131zas\u0131n\u0131 alacak bi\u00e7imde hel\u00e2llik dilenir. Madd\u00ee veya m\u00e2nev\u00ee bir zarara yol a\u00e7\u0131lm\u0131\u015fsa o tazmin edilir.<br \/>\n3-\u0130\u015flenen k\u00f6t\u00fcl\u00fck ki\u015finin haysiyet ve \u015ferefine y\u00f6nelik olup kendisinin haberi yoksa tercih edilen g\u00f6r\u00fc\u015fe g\u00f6re bunlar\u0131 bildirip onu \u00fczmek yerine genel anlamda \u00f6z\u00fcr dileyerek ba\u011f\u0131\u015flanma istenir. Ancak ki\u015finin g\u0131yab\u0131nda yap\u0131lan onur k\u0131r\u0131c\u0131 konu\u015fmalar\u0131n aksinin ayn\u0131 mecliste s\u00f6ylenip tel\u00e2fi yoluna gidilmesinin gerekli oldu\u011fu \u015f\u00fcphesizdir (K\u0101d\u00ee Abd\u00fclcebb\u00e2r, s. 799; \u0130bn Kayyim el-Cevziyye, s. 119-121).<br \/>\n4-T\u00f6vbe konusu g\u00fcnahlar do\u011frudan insanlara, toplum hayat\u0131na y\u00f6nelikse bunlar\u0131n affa u\u011framas\u0131 i\u00e7in mutlaka tel\u00e2fi edilmesi gerekir. Mesel\u00e2 bir yerde \u00e7al\u0131\u015fan ki\u015finin r\u00fc\u015fvetle i\u015f g\u00f6rmesi ya da yolsuzluk yapmas\u0131 durumunda haks\u0131z elde edilen bu kazanc\u0131n hak sahibine iade edilmesi gerekti\u011fi gibi Hz. Peygamber\u2019in \u015fu beyan\u0131 da hat\u0131rlanmal\u0131d\u0131r:<br \/>\n\u201c\u0130sl\u00e2m toplumunda g\u00fczel bir \u00e7\u0131\u011f\u0131r a\u00e7\u0131p kendisinden sonra bu yolda i\u015f g\u00f6r\u00fclen kimsenin amel defterine sonrakilere verilen sevab\u0131n ayn\u0131s\u0131 yaz\u0131l\u0131r; bunun yan\u0131nda toplumda k\u00f6t\u00fc bir \u00e7\u0131\u011f\u0131r a\u00e7\u0131p sonraki d\u00f6nemlerde ona g\u00f6re davran\u0131lan kimse i\u00e7in de berikilere yaz\u0131lan g\u00fcnah\u0131n ayn\u0131s\u0131 yaz\u0131l\u0131r (M\u00fcsned, IV, 357, 359-361; M\u00fcslim, \u201c\u02bf\u0130lim\u201d, 15, \u201cZek\u00e2t\u201d, 69).<\/p>\n<p>T\u00f6vbe, su\u00e7lunun Allah kat\u0131ndaki durumunu iyile\u015ftirebilece\u011fi gibi Allah\u2019\u0131n kabul\u00fcne ba\u011fl\u0131 olarak su\u00e7un uhrev\u00ee cezas\u0131n\u0131 da kald\u0131rabilir; fakat t\u00f6vbenin d\u00fcnyev\u00ee cezay\u0131 kald\u0131rmas\u0131 tart\u0131\u015fmal\u0131d\u0131r. Su\u00e7lunun mahkemeye intikalinden sonra, su\u00e7lunun pi\u015fman olmas\u0131 ve t\u00f6vbe etmesi verilecek cezay\u0131 etkilemez. Ayr\u0131ca t\u00f6vbenin, kul hakk\u0131n\u0131n a\u011f\u0131rl\u0131kta oldu\u011fu k\u0131sas ve diyeti, mali ceza ve tazminatlar\u0131 da d\u00fc\u015f\u00fcrmeyece\u011fi a\u00e7\u0131kt\u0131r. T\u00f6vbenin hadlere etkisine gelince, ilgili ayet, \u201cAncak sizin onlar\u0131 yenip, ele ge\u00e7irmenizden \u00f6nce t\u00f6vbe edenler, bu h\u00fckm\u00fcn d\u0131\u015f\u0131ndad\u0131r. \u00c7\u00fcnk\u00fc bilesiniz ki, Allah \u00e7ok ba\u011f\u0131\u015flayan ve \u00e7ok ac\u0131yand\u0131r\u201d (M\u00e2ide 5\/34) buyurur. Allah-\u00fc Te\u00e2l\u00e2, k\u00f6t\u00fc \u015feyler yapanlar\u0131 t\u00f6vbe ettikleri takdirde, t\u00f6vbelerinden sonra durumlar\u0131n\u0131 iyice d\u00fczelterek hay\u0131rl\u0131 ki\u015filerin yolunda gittiklerini g\u00f6sterirlerse, kendilerini affedece\u011fini vaat etmi\u015ftir.3 Yakalanmazdan \u00f6nce t\u00f6vbe eden bu su\u00e7lular\u0131n affedilece\u011fini bildiriyor. M\u00fcfessirlere g\u00f6re t\u00f6vbe ile Allah\u2019\u0131n hakk\u0131 d\u00fc\u015fer, fakat kullar\u0131n hakk\u0131 d\u00fc\u015fmez.<\/p>\n<p>\u0130sl\u00e2m\u2019da k\u00f6t\u00fc davran\u0131\u015flara ait cezalar\u0131n bir amac\u0131 da ibret te\u015fkil edip su\u00e7 ve g\u00fcnahlar\u0131 ortadan kald\u0131rmakt\u0131r. T\u00f6vbenin de b\u00f6yle bir hedefi vard\u0131r. Buna g\u00f6re sosyal hayat\u0131n bozulmas\u0131na yol a\u00e7an g\u00fcnahlar\u0131n tel\u00e2fisinin de sosyal bir nitelik ta\u015f\u0131mas\u0131 gerekir. T\u00f6vbe edecek kimse haklar\u0131na tecav\u00fcz etti\u011fi ki\u015filerin haklar\u0131n\u0131 iade etmeli, bu ki\u015filerden alenen \u00f6z\u00fcr dilemeli ve kendisi gibi davranan kimseleri de uyarmal\u0131d\u0131r. Emanet ve g\u00fcven esas\u0131na dayal\u0131 olarak sosyal alanda ve kamu y\u00f6netiminde yetki ve sorumluluk \u00fcstlenen kimselerin suistimalde bulunmas\u0131 Kur\u2019an\u2019da \u201ch\u0131yanet\u201d kavram\u0131yla ifade edilmektedir. Etkisi ve tahrip alan\u0131 \u00e7ok geni\u015f olan bu g\u00fcnahlar\u0131n t\u00f6vbesi ve tel\u00e2fisi imk\u00e2ns\u0131z denecek kadar zordur.<\/p>\n<p>\u0130slam, kul ile Allah aras\u0131ndaki ili\u015fkilerde d\u0131\u015far\u0131dan m\u00fcdahil olmaya izin vermez, kulun Allah ile ili\u015fkilerini ve ileti\u015fimini ferdin s\u00fcrd\u00fcrmesini esas al\u0131r. Dolay\u0131s\u0131yla kul ile Allah aras\u0131na arac\u0131y\u0131 da kabul etmez. Kul, ferdi sorumluluklar\u0131 alan\u0131nda yapt\u0131\u011f\u0131 hatalar\u0131ndan, g\u00fcnahlar\u0131ndan dolay\u0131 Rabbine samimiyetle y\u00f6nelir, pi\u015fmanl\u0131\u011f\u0131n\u0131 dile getirir, arzu halini arz eder. Arz makam\u0131 uygun g\u00f6r\u00fcrse dilek ve duas\u0131n\u0131, t\u00f6vbesini kabul eder. Bu noktada hari\u00e7ten birilerinin, \u201ckabul olsun, olmas\u0131n, kabul oldu, olmad\u0131\u201d gibi bir h\u00fck\u00fcm verme yetkisi yoktur. Burada tamamen kul ile Allah aras\u0131ndaki bir hukuk ve ileti\u015fim s\u00f6z konusudur. Takdir Y\u00fcce Yaratan\u2019a aittir. Ancak, g\u00fcnah, su\u00e7, kul ve kamu hukukunu ilgilendiren bir alana ait ise; Y\u00fcce Yaratan\u2019\u0131n ifadesiyle kul hakk\u0131, \u201chakk\u0131 yiyen ile hakk\u0131 yenilen kul aras\u0131ndaki helalle\u015fme\u201d ile \u00e7\u00f6z\u00fcmlenecektir. T\u00f6vbe konusu g\u00fcnahlar do\u011frudan insanlara, toplum hayat\u0131na y\u00f6nelikse bunlar\u0131n affa u\u011framas\u0131 i\u00e7in mutlaka tel\u00e2fi edilmesi gerekir.<\/p>\n<p>Di\u011fer taraftan, toplumun \u00f6n\u00fcnde ve sorumluluk mevkiinde olanlar\u0131n, y\u00f6netiminde yetki ve sorumluluk \u00fcstlenen kimselerin, toplumsal sorumluluklar\u0131n\u0131 yerine getirmeden, kendisine tevdi edilen, emanete sahip \u00e7\u0131kmayarak suistimalde bulunmas\u0131 Kur\u2019an\u2019da \u201ch\u0131yanet\u201d kavram\u0131yla ifade edilmektedir. Etkisi ve tahrip alan\u0131 \u00e7ok geni\u015f olan bu g\u00fcnahlar\u0131n t\u00f6vbesi ve tel\u00e2fisi imk\u00e2ns\u0131z denecek kadar zordur. Yani sorumluluk makam\u0131ndakilerin toplumun menfaatini hi\u00e7e sayarak ve ki\u015fisel \u00e7\u0131karlar\u0131 u\u011fruna dinin, milletin gelece\u011fini ipotek alt\u0131na alan, telafisi imk\u00e2ns\u0131z bir tak\u0131m uygulamalara \u00f6nc\u00fcl\u00fck edip, vatan ve din d\u00fc\u015fmanlar\u0131 ile i\u015fbirli\u011fi yapt\u0131ktan sonra, art\u0131k iktidar ve g\u00fcc\u00fcn\u00fc kaybetti\u011fi, itibar g\u00f6rmedi\u011fi, s\u00f6z hakk\u0131 tan\u0131nmad\u0131\u011f\u0131 bir zamanda; \u201ct\u00f6vbe ettim, pi\u015fman\u0131m, pardon\u201d demesi e\u011fer ortada bir h\u0131yanet ve su\u00e7 varsa bunu ortadan kald\u0131rmaz.<\/p>\n<p>Kald\u0131 ki; bu durumda t\u00f6vbenin \u015fart\u0131n\u0131n ki\u015fisel helalle\u015fme de\u011fil; yap\u0131lan yanl\u0131\u015f ve g\u00fcnah\u0131n, toplumsal zararlar\u0131n\u0131n, etkilerinin telafisi ile m\u00fcmk\u00fcn oldu\u011funu izah etmi\u015ftik. Ayr\u0131ca; ge\u00e7mi\u015fte yap\u0131lan hatalar\u0131 tespit etmek, hatal\u0131-kusurlu ya da kas\u0131tl\u0131, ihanet sahibi ki\u015filer, \u015fahsiyetler varsa, bunlar\u0131 ortaya koymak, ayn\u0131 hatalar\u0131n yap\u0131lmamas\u0131, dost ve d\u00fc\u015fman\u0131n bellenmesi, bilinmesi, toplumsal haf\u0131zam\u0131z\u0131n ger\u00e7eklerle uyar\u0131lmas\u0131 a\u00e7\u0131s\u0131ndan son derece \u00f6nemlidir. Buna y\u00f6nelik yap\u0131lan uyar\u0131lar, \u015fahsiyet tahlilleri de \u201cg\u0131ybet\u201d kapsam\u0131nda de\u011ferlendirilemez. E\u011fer b\u00f6yle d\u00fc\u015f\u00fcn\u00fcrsek tarihi olaylar\u0131, tarihi \u015fahsiyetleri, uygulamalar\u0131n\u0131 konu\u015fmay\u0131 da g\u0131ybet olarak de\u011ferlendirmemiz gerekir ki; bu ne dinin ne de ilmin kabul edebilece\u011fi bir \u015fey de\u011fildir. Aksini d\u00fc\u015f\u00fcrsek, tarih diye bir bilime de gerek kalmaz zaten!<\/p>\n<p>M\u00fcsl\u00fcman hata, su\u00e7, g\u00fcnah i\u015fleyince \u00f6ncelikle onu terk edecek, nedamet duyacak, telafisi yoluna gidecek, kul hakk\u0131 varsa helalle\u015fecek, toplumsal bir durum varsa bedelini \u00f6deyecek sonra Rabbinden de aff\u0131n\u0131 talep edecek. Bilecek ki; t\u00f6vbe ahirete y\u00f6nelik olup i\u015flenen bir su\u00e7u yok saymaz, hakikati gizlemez, hukuki cezay\u0131 da ortadan kald\u0131rmaz. \u00d6nc\u00fc ve \u00f6nde olanlar\u0131n sorumluluklar\u0131 daha b\u00fcy\u00fck olup ona g\u00f6re davranmalar\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r.
